Psych Records For Boy Victim in Sex Case to go to Judge Before Lawyer

A prosecutor said he will ask the mother of an alleged sexual abuse victim about her son's previous psychiatric treatment.

A Will County judge said she will review any psychiatric history obtained about a boy allegedly abused sexually at the hands of a teenager.

Judge Sarah Jones said during a Thursday morning hearing that she will then decide whether the records can be seen by the attorney for 19-year-old defendant Jason Minger of Plainfield.

Minger was arrested in May 2012 for allegedly abusing a boy over the course of a year. The alleged abuse may have been committed nearly two years prior to Minger's arrest, according to court papers. The boy would have been 10 years old at the time of the alleged abuse.

Minger's lawyer, Neil Patel, is trying to get a hold of the alleged victim's psychiatric records. At an earlier court hearing, Patel told Judge Jones the boy was undergoing counseling when he told his mother Minger sexually abused him, but he had never mentioned the abuse to his counselor. Patel also said the boy was twice admitted to an in-patient facility, once for a week and once for two weeks.

"I'm sure the in-patient treatment was related to mental health issues," Patel said at that previous hearing.

Assistant State's Attorney Derek Ewanic said he would speak with the boy's mother and try to find out where her son was treated so Patel could subpoena the appropriate facilities and practitioners.
